Terms of Use
By accessing, registering or using the MC TEA platform, the user declares having read, understood and fully agreed to these Terms of Use. If the user does not agree with any provision described herein, they must refrain from using the platform.
MC TEA reserves the right to modify these Terms of Use at any time, and it is the user's responsibility to consult them periodically. Continued use of the platform after any changes implies acceptance of the new conditions.
These terms are governed by the laws of the Federative Republic of Brazil, in particular the General Data Protection Law (LGPD - Law No. 13,709/2018), the Internet Civil Framework (Law No. 12,965/2014) and the Consumer Defense Code (Law No. 8,078/1990), when applicable.
Registration and User Account
To use the platform's features, the user must create an account providing truthful, complete and up-to-date information. The user is solely responsible for:
- Maintain the accuracy and currency of your registration data
- Preserve the confidentiality of your password and access credentials
- All activities performed on their account, regardless of who executed them
- Immediately notifying MC TEA in case of unauthorized use of their account or any security breach
MC TEA reserves the right to suspend or cancel accounts that contain false or incomplete information or that violate these Terms of Use, without prior notice.
Intellectual Property
All intellectual property rights related to the MC TEA platform, including but not limited to software, algorithms, graphical interface, design, logos, trademarks, institutional texts and technical documentation, are the exclusive property of MC TEA or its licensors.
Content inserted by the user on the platform (technology descriptions, assessments, project data) remains the property of the respective user. By inserting content on the platform, the user grants MC TEA a non-exclusive, free and revocable license to:
- Store, process and display content within the platform
- Use anonymized and aggregated data for statistical purposes and service improvement
- Perform matching and comparison operations with other platform data
The user declares that they have the necessary rights over all content they insert on the platform and that such content does not violate third-party rights.
Platform Usage
MC TEA grants the user a personal, non-transferable, non-exclusive and revocable license to access and use the platform exclusively for its intended purposes, according to the contracted plan.
The platform provides different levels of functionality according to the user's plan:
- Free Plan: basic access with limited assessment and visualization features
- Paid Plans: extended access to advanced matching features, AI analysis, detailed reports and expanded registration capacity
Prohibited Conduct
The following is expressly prohibited to the user, under penalty of suspension or banning from the platform and civil and criminal liability:
- False or misleading data: Inserting false, fraudulent, inaccurate or misleading information in technology registrations, assessments or user profiles
- Misuse: Using the platform for illicit, immoral, unethical purposes or contrary to its purpose
- Reverse engineering: Reverse engineering, decompiling, disassembling or attempting to access the platform's source code, algorithms or databases
- Automated collection: Using robots, scrapers, crawlers or any automated means to access, collect or extract data from the platform without express authorization
- Spam and abusive communication: Sending unsolicited messages, spam, advertising or promotional content to other users through the platform
- Security violation: Attempting to access third-party accounts, restricted areas of the system, or circumventing security and authentication mechanisms
- Offensive content: Publishing or transmitting discriminatory, defamatory, threatening, obscene content or content that violates fundamental rights
- Credential sharing: Sharing, selling, transferring or assigning your account or access credentials to third parties
- System overload: Performing actions that compromise the stability, security or operation of the platform, including denial of service attacks (DoS/DDoS)
- Intellectual property violation: Copying, reproducing, distributing or creating derivative works from platform content or other users' content without authorization
- Result manipulation: Attempting to artificially manipulate matching algorithms, assessment scores or platform rankings
Responsibilities and Limitations
MC TEA Responsibilities
- Keep the platform available and operational, making reasonable efforts to ensure its stability and security
- Protect user data in accordance with LGPD and information security best practices
- Provide technical support to users within established deadlines and channels
- Communicate relevant changes to the Terms of Use, features or platform policies
Limitation of Liability
- MC TEA does not guarantee that the platform will be available uninterruptedly or error-free. Scheduled maintenance and occasional interruptions may occur
- TRL, CRIT and AE assessments are decision support tools and do not replace specialized technical analyses. MC TEA is not responsible for decisions made based solely on platform results
- Matching results (partnerships, benchmarking and calls) are suggestions based on similarity algorithms and do not constitute formal recommendations or guarantees of compatibility
- MC TEA is not responsible for content inserted by users, including the accuracy and precision of information about technologies, projects and institutions
- MC TEA is not responsible for direct, indirect, incidental, consequential or punitive damages arising from the use or inability to use the platform
General Provisions
- Validity: These Terms of Use come into effect on the date of user registration and remain valid while the account is active
- Severability: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force
- Assignment: The user may not assign or transfer their rights and obligations arising from these Terms without prior consent from MC TEA
- Applicable legislation: These Terms are governed by the laws of the Federative Republic of Brazil
- Jurisdiction: The forum of the District of Brasilia/DF is elected to settle any disputes arising from these Terms, with waiver of any other, however privileged it may be
Privacy and Data Protection
MC TEA is committed to protecting the personal data of its users, in compliance with the General Data Protection Law (LGPD).
Collected Data
- Registration data: name, email, institution, area of expertise and professional information
- Usage data: assessments performed, registered technologies, platform interactions and access history
- Technical data: IP address, browser type, operating system and session data, automatically collected for security and service improvement purposes
Purpose of Processing
- Provision and improvement of platform services
- Operation of matching and recommendation algorithms
- Generation of aggregated and anonymized statistics and reports
- Communication with the user about relevant updates and news
- Compliance with legal and regulatory obligations
Data Sharing
MC TEA does not sell personal data of its users. Data may only be shared in the following cases:
- With other platform users, limited to information that the user has chosen to make visible in their profile and matching features
- With service providers essential to the platform's operation (hosting, payment processing), under confidentiality agreements
- By legal, judicial or competent authority determination
Cookies and Tracking Technologies
The platform uses essential cookies for the authentication system and user session maintenance. Session cookies are temporary and removed when closing the browser.
Data Subject Rights
In compliance with LGPD, the user may exercise the following rights by requesting MC TEA:
- Confirmation of the existence of data processing
- Access, correction and update of your personal data
- Anonymization, blocking or deletion of unnecessary or excessive data
- Data portability to another provider
- Deletion of personal data processed based on consent
- Revocation of consent at any time
Plans and Payments
MC TEA offers free and paid plans. Paid plans are charged according to the periodicity chosen by the user at the time of subscription.
- Prices are subject to change, however changes do not affect plans already contracted until the end of the current period
- Payment is processed through third-party payment platforms (PayPal, MercadoPago), and MC TEA does not store credit card data
- Plan cancellation can be done at any time by the user, with access maintained until the end of the already paid period
- Refunds will be evaluated on a case-by-case basis, in accordance with the Consumer Defense Code, when applicable
